The present document establishes the general conditions which form an integral part of the rental contract between the occupants of the properties, ie YOU and the company ALQUILERES OLTASUCH SL, with domicile in Calpe, Calle de la Pau Nº 2 and CIF register number B-54575436 ; subsequently named PLUSHOLIDAYS, OUR or US.
When a reservation is made, independently of the reservation site (directly through our PLUSHOLIDAYS website, where external websites, agencies or tour operators with which PLUSHOLIDAYS collaborates) YOU accept each and every one of the conditions indicated below.
1- PRICES AND SERVICES
The announced prices of our villas, terraced houses and apartments will be stipulated per day or per week.
In principle, during the high season, the minimum stay is 7 nights with entry and exit on Saturday. During the medium or low season, rentals may start on another day of the week and the stay may be shorter.
Additional costs such as cleaning, sheets, towels, air conditioning, heating, extra bed, cot, high chair etc ... may or may not be included in the price, it depends on each property. In cases where it is not included in the rental price, this will be specified before confirmation of the conditions of the reservation and making the reservation; moreover it will be indicated in the invoice detailing the reservation.
2- MODIFICATION OF PRICES AND SERVICES
The prices and services may in certain cases suffer from modifications which would be communicated when making the reservation and subsequently confirmed in writing.
It is possible that modifications arise after having made the reservation and which affect important points of the contract. In this case you can cancel the contract, within five days, and the money paid will be fully refunded.
3- RESERVATION AND PAYMENT CONDITIONS
Reservations can be made from our website www.plusholidays.es, or by phone by calling our agency (0034) 965 833 587 or directly at our PLUSHOLIDAYS offices.
* Standard rate: 60% of the amount of accommodation. The remaining balance will be paid upon entry, upon delivery of the keys.
Payments can be made by bank transfer (IBAN: ES90 2095 0203 8091 1170 5417, BIC: BASKES2BXXX), bank card (VISA or MASTERCARD) or in cash.
In the event that payment deadlines are not met with a maximum of 4 working days, PLUSHOLIDAYS reserves the right to cancel the reservation without notice.
-Free cancellation up to 14 days before arrival.
- After this period, the reservation may be canceled with a penalty of 60% on the total price of the reservation.
On the day of entry it is compulsory to present a bank card, which will be recorded as an imprint for the deposit, as a guarantee in the event of improper use of the property or any damage caused by the occupants as indicated in the general conditions. In the event that a bank card is not presented, PLUSHOLIDAYS reserves the right to prohibit entry to the accommodation, losing the tenant's payments made to date.
6- CLIENT OBLIGATIONS AND CONDITIONS OF USE
The occupancy of the accommodation will be limited to the number of people who will be indicated in the reservation, children and babies are also counted as persons in the reservation. PLUSHOLIDAYS may prohibit entry to the accommodation in case of exceeding the number of occupants allowed, without any right to compensation, or even by increasing the rental price according to the amount that the tenant thinks correct.
The tenant must respect the conditions of coexistence between neighbors and the municipal conditions of the place of rental. It is totally forbidden to celebrate ceremonies or parties in all PLUSHOLIDAYS properties. In the event of negligence or inappropriate behavior, PLUSHOLIDAYS takes the right to cancel the rental contract immediately without any notice, and the total amount of the deposit may be lost as well as the amount of the reservation.
The presence of pets will only be allowed in cases where this has been confirmed in the reservation. If we find that there are more pets without it being written in the reservation, PLUSHOLIDAYS takes the right to cancel the rental agreement immediately without any notice, and the total amount of the deposit may be lost as well as the amount of the reservation.
7- MAINTENANCE AND STORAGE
The accommodation will be given in perfect condition for rental and it is forbidden to change the decoration or the arrangement of the furniture.
The delivery of the keys must be done under the same conditions in which the property was made available, clean and orderly, without any garbage, they must be discarded by the tenants. The cupboards and fridge must be emptied.
Disorder, dirt and trash will be penalized with the deposit of € 150.
In the event of not returning the keys or having lost them, PLUSHOLIDAYS agrees the right to deduct from the deposit a minimum of € 50 as an additional charge.
8- DELIVERY OF KEYS FOR ENTRY AND EXIT
The keys will be handed over between 5 p.m. and 8 p.m. at the PLUSHOLIDAYS agency, and the last amount plus supplements must be paid on site.
For check in after 20:00, the reservation must be fully paid and the online check in must be done to collect the keys. Arrivals after 20:00 carry a supplement of € 50.
Departures must be no later than 10 a.m., keys must be handed over to the PLUSHOLDIAYS agency. The rental must be returned in the same condition as it was given on the day of entry, orderly and without trash. Otherwise then there will be a penalty according to the booking conditions.
9- COMMITMENT FROM PLUSHOLIDAYS
In the event that the accommodation booked, for unforeseen reasons not attributable to PLUSHOLIDAYS, serious unforeseen events which do not allow access to the rental, PLUSHOLIDAYS undertakes to seek an alternative solution with the same characteristics and prices. In the event that it is impossible to change for lack of accommodation or because YOU refuse the offers offered, then we will refund the amounts paid.
10- INCIDENTS AND CLAIMS
Even if we have meticulously prepared our web page and checked all our properties, it is possible that a service is not to your total satisfaction. In this case, YOU must communicate it within 48 hours from the day of delivery of the keys. PLUSHOLIDAYS has a 24 hour emergency service and our team will try to resolve your issues as quickly as possible.
It is important that the tenant assumes and understands that the existence of incidents is inherent in the simple use of the accommodation. In some cases, incidents may not be anticipated in advance (example: problem with the septic tank, boiler problem, plumbing problem, electricity problem, etc.) and other problems may be out of the question. our responsibility (example: general power outage, work in the neighborhood, noisy neighbors, or noisy pets, existence of insects, etc.).
The PLUSHOLIDAYS team remains at your disposal throughout your stay to be attentive to answering your questions and to help you make the most of your vacation.
11- EXORENATIONS OF RESPONSIBILITIES
PLUSHOLIDAYS assumes no responsibility for modifications that affect or around the accommodation that is beyond the control of PLUSHOLIDAYS. The tenant assumes that he can not claim anything as a penalty for these following anomalies, still being that the agency could not have done anything to predict or prevent them:
- Works: the dwellings are generally private property of different owners and they are generally located in a large residential area.
The accommodation in general is not in tourist complexes, so it is possible that there are unforeseen works in the surroundings. The works are generally organized by owners, contractors or administration with whom we have no relationship and that is why we have no power over the works. For this the tenant assumes the reservation contract for the accommodation, that neither PLUSHOLIDAYS, nor the owner of the accommodation are responsible for noise caused by work external to the rental.
- Satellite / cable television: If in the description it is stated that the television is by satellite or cable, this does not mean that you will have all the channels desired. The owners of the accommodation, most of the time are foreign, they have decoders but the televisions do not necessarily receive all the international channels.
- Water, electricity and the Internet: Water, electricity and Internet outages are not frequent in the Valencian community, but municipalities, for various reasons, may suffer temporary power cuts or limit distribution. Under no circumstances will PLUSHOLIDAYS be responsible for any inconvenience or damage caused.
12- DATA PROTECTION
The personal data facilitated by the tenant in the contract form or reservation form, will be incorporated in a file belonging to PLUSHOLIDAYS. The purpose of the collection and processing of personal data is the administrative management of the reserved service, the correspondence of commercial relations, as well as to inform you of services and offers. In accordance with the regulations in force, PLUSHOLIDAYS guarantees that it has adopted the measures necessary to maintain the required level of security depending on the nature of the personal data processed. We inform you that you can exercise your rights of access, rectification, cancellation and opposition concerning your personal data, by sending an email accompanied by your identity document, to the address indicated in the booking voucher .
PLUSHOLIDAYS will not give up and will not give to anyone the data recorded in the reservation form, except in the case where the tenant communicates the authorization, required by current legislation or is necessary for the requested service.
13- APPLICABLE LEGISLATION AND JURISDICTION
In all that is not foreseen in the current conditions, it will be applicable, in any case, the Spanish legislation, as well as the automatic regulation. The parties, who expressly waive the jurisdiction which corresponds to them by law, are subject to the jurisdiction and jurisdiction of the courts of the city of Denia for the resolution of any derivative of the claim and the interpretation of this contract.
